Emergency services were called to New England Highway, Garoo, approximately 40km south of Tamworth, just after 3.40pm on February 13, following reports of a collision between an SUV and a ute.

Officers attached to Oxley Police District were told the vehicles collided before the ute left the roadway and rolled.

The driver of ute – a 30-year-old man – was treated by NSW Ambulance paramedics before being taken to Tamworth Hospital in a serious condition with neck injuries.

The SUV driver – a 37-year-old woman – was subjected to a roadside breath test, which returned a positive result.

She was treated by NSW Ambulance paramedics before being taken to the same hospital for further treatment and mandatory testing.

A crime scene was established and officers attached to Oxley Police District, with the assistance from Crash Investigation Unit and Traffic and Highway Patrol Command, commenced an investigation into the incident.

The woman allegedly returned a blood alcohol reading of 0.232.

Following inquiries by the Northern Tablelands Crash Investigation Unit, the 37-year-old woman was issued a Court Attendance Notice on Tuesday for the charges of drive with high range PCA first offence, aggravated dangerous driving occasioning grievous bodily harm and negligent driving (occasions grievous bodily harm) first offence.
